Subclass 186 Visa Lawyer Bendigo
Employer Nomination Scheme – Permanent Employer Sponsored Visa
The Subclass 186 Employer Nomination Scheme visa allows eligible Australian employers to nominate skilled workers for permanent residence in Australia.
Unlike temporary employer-sponsored visas, the Subclass 186 is a permanent visa. It permits the holder to travel to and enter Australia for five years from the date of grant and provides permanent residence status.
At O’Haire Legal, we assist employers and skilled workers with Subclass 186 visa applications, including applications under the:
Temporary Residence Transition stream;
Direct Entry stream; and
Labour Agreement stream.
The requirements differ significantly depending on the stream, occupation, applicant's visa history and employment circumstances.
Temporary Residence Transition Stream
The TRT stream is generally for eligible sponsored workers transitioning from temporary employer-sponsored visas to permanent residence.
Applicants must generally:
be under 45 unless an exemption applies;
have Competent English;
meet the relevant sponsored employment requirements; and
be nominated for the relevant position under the TRT stream.
From 7 December 2024, applicants no longer necessarily need to have worked with the same employer for the whole qualifying period. Certain periods of sponsored employment with previous employers may count.
Direct Entry Stream
The Direct Entry stream may suit applicants who are not eligible for TRT.
Applicants generally need:
to be under 45 unless an exemption applies;
Competent English;
a suitable skills assessment;
at least three years of relevant skilled work experience; and
an approved nomination for an eligible occupation.
The work experience must be at the required skill level and generally correspond with the nominated occupation
Labour Agreement Stream
The Labour Agreement stream applies where an employer is sponsoring a worker under an applicable labour agreement.
The applicant must meet the terms of that agreement, including any relevant requirements relating to:
age;
qualifications;
work experience; and
English.
Can Family Members Be Included?
Eligible family members may generally be included in the application.
Adult secondary applicants who do not have Functional English may be required to pay a second instalment of the visa application charge before grant.
